I agree that torture is inevitable, I also agree that laws could provide a clearer picture for the people involved. Define the measures to be taken when torture is used and clearly identify when it is time to stop. Dershowitz's argument is in line with Stuart Mills' idea of consequentialism. The greatest good of all is taken into consideration in the decision-making process. But Kant would say that legalizing torture does not make it morally right.
